ClawBack.capital is a trading name of Samurai Network Ltd, a private limited company registered in England and Wales, company number 15863898. Registered office: 98 South Bridge Road, Hull, England, HU9 1TL. In these Terms, "we", "us" and "our" mean that company, and "you" means the person using our services.
These Terms apply when you use any ClawBack.capital service: the website clawback.capital and its subdomains, our apps, and any API we provide ("our services"). By creating an account or using our services you agree to these Terms. If you do not agree, do not use our services.
1. What we provide
ClawBack.capital provides educational market analysis and tools:
- SENSEI Outlooks — prepared chart analysis by our AI analyst, published in DOJO, together with Status, which shows how every published Outlook turned out;
- KAGAMI — charts and indicators;
- TAIKO — alerts when a new Outlook is published;
- GENKAN — your account, plans and billing;
- TORII — the sign-in for all of them.
Some services are free; others need a paid plan, described on our pricing page and in the Subscription Terms.
Everything we publish is general education for everyone. It is not personal advice, it does not take your circumstances into account, and it is not an offer or a recommendation to buy or sell any investment. We do not hold your money, we do not place trades for you and we do not manage anyone's investments. Read the Risk Disclaimer before you use any service.
2. Eligibility
You may use our services only if all of the following are true:
- You are at least 18 years old and able to enter into a binding contract.
- We have not previously suspended or ended your account.
- You live in a country where we offer the service, and using it is lawful for you there.
- Your use of our services complies with the laws and regulations that apply to you.
3. Connected brokerage accounts
We do not currently connect to your brokerage account. If we add a feature that does, it will come with its own terms, which you will be asked to accept before you can use it.
4. Trading risk
Trading is high risk: you can lose all the money you trade with, and with leveraged products you can lose more. Every decision to trade, or not to trade, is yours alone, and so is its result.
- How past Outlooks turned out does not tell you how the next one will.
- Analysis can be wrong, and market data from third parties can be late or wrong.
- A service can be interrupted. Never rely on our services being available for a position you hold.
The Risk Disclaimer explains these risks in full.
5. Your responsibilities
By using our services you agree:
- To give accurate information when you create your account, and to keep it up to date.
- To make your own trading decisions and to watch your own positions — we are not your adviser.
- To comply with all laws that apply to you, including tax rules and sanctions.
- To not use our services, or anything we publish, for market manipulation or any other market abuse.
- To not attempt to reverse-engineer, decompile or otherwise extract source code from any non-public part of our services.
- To not redistribute, sublicense or resell access to our services or to what we publish (see the Acceptable Use rules).
- To tell us promptly if you suspect that someone else has used your account.
6. Intellectual property
Our services and their code, design, content, branding (including "ClawBack.capital", "SENSEI", "DOJO", "KAGAMI", "TAIKO" and "GENKAN") and documentation belong to us. Nothing in these Terms gives you ownership of any of them; you may use them as these Terms and the Acceptable Use rules allow.
You keep ownership of your own data and of anything you send us. We claim no interest in your trading or its results.
7. Prohibited conduct
You may not:
- Use our services to harm or defraud anyone, including other customers.
- Try to gain unauthorised access to our services, to other customers' accounts, or to the systems behind them.
- Use our services for market abuse or for anything else that is unlawful where you are.
- Probe, scan or stress-test our systems without our prior written permission.
8. Suspension and ending your access
We may suspend or end your access at once if you seriously break these Terms or the Acceptable Use rules, or if the law requires it. We may stop a service for any other reason by giving you at least 30 days' notice; if you have paid for a period after it stops, we refund that part.
You can stop using our services at any time: cancel any paid plan in GENKAN › Billing (see the Subscription Terms) and delete your account in GENKAN › Account. When you delete your account, we delete your data as the Privacy Policy describes.
9. Care and availability
We provide our services with reasonable care and skill, and as described. Market data comes from third parties and can be late or wrong, analysis can be wrong, and a service can be interrupted; we do not promise that any analysis is correct or that any service will always be available. This does not affect your statutory rights.
10. Limitation of liability
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit, and your statutory rights as a consumer are unaffected.
Otherwise:
- Every trading decision is yours, so we are not liable for trading losses, or for profits you did not make, from trades you make or do not make.
- Our total liability to you for all claims connected with our services is limited to the greater of £100 and the amount you paid us in the twelve months before the claim.
This section is the only limit on our liability; the Risk Disclaimer sets no other.
11. If you break these Terms
If you break these Terms, you are responsible for the losses this foreseeably causes us.
12. Changes to these Terms
We may change these Terms for a valid reason, such as a change in the law or in our services. We will tell you at least 30 days before a material change takes effect and ask you to accept it. If you do not accept it, you can end your plan before then and we will refund any period you have paid for after the change.
13. Governing law and courts
These Terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and if you live elsewhere you keep any protection the law of your country gives you.
14. Our agreement with you
Our agreement with you is made up of these Terms of Use, the Subscription Terms, the Acceptable Use rules and the Risk Disclaimer. The Privacy Policy and the Cookie Policy explain how we use your data; they are not contract terms. If two documents conflict, these Terms apply, except that the Subscription Terms apply to plans, payments, cancellation and refunds.
If a court finds any part of these Terms invalid or unenforceable, the rest stays in force.
