ClawBack.capital publishes educational chart analysis, market commentary, live sessions and charting tools. Nothing on this platform is investment advice, and trading can lose you money. Read this document before you use any of our services.
1. Educational, not advice
Every analysis, outlook, signal, chart, score, live session, comment and data point on this platform ("content") is educational and informational material produced for a general audience. It is not investment, financial, legal, tax or accounting advice, and it is not a personal recommendation to buy, sell or hold any instrument. A mention of a stock, a coin, a commodity, a currency pair or any other asset is never a signal to trade it. We do not know your circumstances, objectives or experience, and nothing we publish takes them into account.
2. Not a regulated firm
ClawBack.capital is a publisher of educational content. We are not authorised or regulated by any financial regulator, we are not a broker, an exchange, a fund or an investment adviser, we do not hold client money, we do not execute trades on your behalf and we do not manage anyone's portfolio. Nobody who works with us is authorised to give you personal investment advice, and you must not rely on any statement by any member of our team as if it were. If a service in your country would require a licence we do not hold, that service is not offered to you.
3. You can lose money
Trading stocks, derivatives, foreign exchange, commodities and crypto-assets is speculative and carries a high level of risk. Prices move quickly, markets gap and halt, liquidity disappears, and leverage multiplies losses. You can lose some or all of the money you trade with, and with leveraged products you can lose more than you put in. Only trade with money you can afford to lose in full. Never use money set aside for living costs, rent, debt, education or retirement.
Small-cap, low-priced and thinly traded instruments carry extra risk: public information about them is often scarce or unaudited, listing standards may be minimal, spreads are wide, demand is unpredictable, price swings are violent, and they are a common target for manipulation. Crypto-assets add exchange failure, custody loss and 24/7 trading with no circuit breakers.
4. No guarantee of results
Nothing we publish promises or implies any result. Past performance, back-tests, simulated or hypothetical results, published outcomes and scores are not a guide to future results. An outcome recorded against an analysis describes what the market did afterwards; it does not mean the analysis was advice, that it was followed by anyone, or that a similar outcome will follow next time.
Hypothetical and simulated results have inherent limits. They are prepared with the benefit of hindsight, they involve no financial risk, they ignore the effect of fear, hesitation and position size on a real trader, and they usually ignore commissions, slippage, delays and the absence of liquidity at the moment you act. Real results differ, sometimes sharply. Most people who attempt active trading lose money. Any trading record or screen we show, including during a live session, is a demonstration and not a representation that any account will achieve anything similar.
5. Your decisions, your responsibility
Every decision to trade or not to trade, the instrument, the direction, the timing, the size and the management of every position, is yours alone. You are responsible for your own research, your own risk management, your own tax position and the suitability of any product for you. Before trading, consider your objectives, your experience and your appetite for risk, practise in a simulator, and take independent advice from a regulated adviser if you are unsure. Do not copy, mirror or blindly follow SENSEI, our team, our contributors or anyone else.
6. Our own trading
ClawBack.capital, its owner, contributors and partners ("our team") are active traders and may hold positions in the instruments we discuss. We manage this conflict as follows:
- A member of our team does not buy or sell an instrument in the 24 hours before an Outlook or a live session about it is published, or in the 24 hours after.
- When the author of an Outlook, or the host of a live session, holds a position in the instrument discussed, the Outlook or the session says so at the time.
- We keep a record of our team's dealings in the instruments we discuss.
Even so, our interests may differ from yours. Never treat a mention as a cue to trade.
7. Data, tools and third parties
Prices, charts, quotes, news and market data come from third parties and may be delayed, incomplete, revised or wrong. Our charting tools, scanners, indicators and scores are provided so you can do your own research on your own criteria; they are one input among many, they are not a basis for a trade on their own, and not every instrument or data field is available in them. We do not independently verify third-party data, and we have no obligation to correct or update any content once published. Brokers, exchanges, wallets, payment providers and other third-party services are independent businesses with their own terms; we do not control them, we do not endorse them, and we are not responsible for their availability, execution, fees, security or failure. Links to other websites are provided for convenience only and do not imply approval of anything on them.
8. Testimonials and community
Any testimonial, review, screenshot or description of someone's experience with our services reflects that person's own circumstances and is not typical. You should not expect the same or similar results. Where our services carry community areas, live chat or user comments, what other users post is their own opinion, is not reviewed or endorsed by us, may reflect positions they hold, and may be removed by us at any time. Your participation is at your own risk.
9. Care and availability
We provide our services with reasonable care and skill, and as described. Market data comes from third parties and can be late or wrong, analysis can be wrong, and a service can be interrupted; we do not promise that any analysis is correct or that any service will always be available. A live session may drop, a chart may lag, an alert may arrive late or not at all: never rely on our availability for a position you hold. This does not affect your statutory rights.
10. Limitation of liability
Our liability to you is set out in one place: section 10 of the Terms of Use. In short, every decision to trade is yours, so we are not liable for trading losses, or for profits you did not make, from trades you make or do not make. Nothing limits our liability where the law does not allow it, and your statutory rights as a consumer are unaffected.
11. If you break our terms
If you break our Terms of Use, you are responsible for the losses this foreseeably causes us.
12. Governing law and changes
This document is governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and if you live elsewhere you keep any protection the law of your country gives you. We may update this document; the version and effective date are shown at the top, and when we make a material change we ask you to accept the new version. If any part of this document is found unenforceable, the rest stays in force.
